Welcome to TechCreative (“we,” “our,” or “us”), a WordPress development and digital solutions agency, sole proprietor of TechCreative. These Terms of Service (“Terms”) govern your access to and use of our website https://techcreative.dev and any products, services, or digital solutions we provide (collectively, the “Services”).

By using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use of our Services.

2. Our Services

TechCreative provides professional development and digital services including:

    • WordPress design and development

    • Membership and Learning Management System (LMS) website creation

    • WooCommerce and E-commerce platform setup

    • Mobile app development and API integration

    • Custom plugin and automation development

Each project is governed by a written proposal or agreement that specifies deliverables, scope, timeline, and payment terms.

3. Client Responsibilities

Clients agree to:

    • Provide complete, accurate, and timely information necessary for project development.

    • Review and approve project milestones or deliverables promptly.

    • Ensure that all materials provided (text, images, videos, logos, etc.) do not infringe any third-party rights.

Clients are responsible for maintaining backups and ensuring website content complies with all applicable laws and regulations.

4. Payments and Fees

Payment terms are outlined in each individual project agreement.

    • A deposit may be required before work begins.

    • Remaining payments are due according to the agreed schedule.

    • Delayed payments may result in project suspension or additional fees.

All fees are non-refundable once work has commenced, unless otherwise agreed in writing by both parties.

5. Revisions and Maintenance

Each project includes a specific number of revisions as stated in the proposal.
Additional revisions or change requests beyond that scope may incur extra charges.

Ongoing support, hosting, and maintenance are not included unless explicitly mentioned in the contract or covered under a separate maintenance plan.

6. Intellectual Property

Upon full payment:

    • Ownership of the final deliverables (custom code, design, and content) transfers to the client.

    • TechCreative retains the right to use non-confidential project elements, designs, or screenshots for portfolio and marketing purposes.

    • Third-party plugins, themes, or tools remain subject to their own licensing terms.

Reusable code snippets, frameworks, and methodologies developed by TechCreative remain the intellectual property of Trim Kjemali / TechCreative.

7. Confidentiality

Both parties agree to treat all project-related and business information as confidential. Neither party will disclose such information to third parties without written consent, except where required by law.

8. Limitation of Liability

To the maximum extent permitted by law, TechCreative and Trim Kjemali shall not be liable for any indirect, incidental, or consequential damages, including but not limited to data loss, downtime, or lost profits.

Our total liability for any claim related to the Services will not exceed the total amount paid by the client for the specific project giving rise to the claim.

9. Third-Party Services

TechCreative may utilize third-party tools, APIs, or services (e.g., WordPress plugins, payment gateways, CRMs).
You acknowledge that:

    • We are not responsible for the functionality, availability, or terms of such third-party services.

    • Your use of those services is governed by the third-party providers’ terms and conditions.

10. Termination

Either party may terminate a project or service agreement with written notice if the other party breaches these Terms.

Upon termination:

    • The client must pay for all completed or in-progress work up to the termination date.

    • Ownership of deliverables will transfer only upon full payment.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of North Macedonia, without regard to its conflict of law principles.

12. Updates to These Terms

We reserve the right to modify or update these Terms at any time.
All updates will be posted on this page with a revised “Last Updated” date. Continued use of our Services constitutes acceptance of the new Terms.
